To determine the feasibility and implementation timelines for Partners joining the WIPO Digital Access Service (DAS) based priority document exchange system and/or SIPO’s Verifiable Priority Document (VPD) system.

This project compares the provisions and practices of the ID5 Partner Offices and the Hague System regarding specific tools and legal effects that can postpone the publication of designs and restrictions on enforcement of the rights under the unpublished condition. How the applicant decides when to publish the design varies by jurisdiction: Deferment of initiation of examination at the application stage, deferment of publication after registration, providing predictable examination period provided by the office. In this project, we take into account all the methods that can delay the aforementioned publication of industrial design applications or industrial design rights. The purpose of this catalogue is to promote users’ understanding of each jurisdiction’s design publication deferment system and use it in design management strategies.

The aim of the project “Study of Term of Protection and the Manner and Framework for Obtaining that Term of Protection for Industrial Design rights” is to compare the provisions and different practices related to the various terms of protection for industrial designs. The purpose will be to identify where legal frameworks and office practices meet user needs to protect industrial design and to identify where legal frameworks and office practices could potentially be enhanced.

The five Partner Offices have certain diverse laws and practices regarding the foreign priority right system for industrial designs. To better understand the differences, an in-depth comparative study on foreign priority right systems for industrial designs was conducted.

The purpose of the “Comparative study of practices concerning product indications” is to allow a better understanding of the respective differences among the practices of the ID5 Offices for the benefit of Offices and users.

The aim of the project “Recommended Design Practices” is to produce an agreed set of recommended but non-binding provisions endorsed by the ID5 Partners.

The purpose of the “Update of the Catalogue of View and Drawing Requirements” Project is to update the current catalogue that was approved during the design session of the TM5 meeting in 2013, in particular taking into consideration the recent adhesion to The Hague Agreement of the USPTO and JPO. Further the catalogue needs to be geographically extended to China, SIPO being one of the ID5 Partners since 2015. Finally, a maintenance methodology needs to be defined.

For the Partners to work for mutual understanding by collecting and organizing the information regarding their respective design classification systems and operations and sharing them among the Partners.

To catalogue and compare the provisions related to a grace period for industrial designs for each of the Partners, and how the grace period is applied in respective jurisdictions.

To catalogue and compare the provisions related to the protection of partial designs for each of the Partners (i.e., a designs for less than the entire article/product), including use of broken lines and other depiction mechanisms.
