The ID5 group will be welcomed in Jeju, South Korea by the 2023 host, the Korean Intellectual Property Office (KIPO) for this year’s midterm meeting on 12 and 13 June.

ID5 partner offices will exchange information and practices on protecting digital designs in the metaverse. They will also discuss recommended design practices and a User Guide of the view and drawing requirements for designs.

Partner offices will also look at implementing new projects such as an e-learning platform for SMEs and registered design indications.

Brussels, Hybrid Meeting

October 27-28, 2022

The China National Intellectual Property Administration (CNIPA), the European Union Intellectual Property Office (EUIPO), the Japan Patent Office (JPO), the Korean Intellectual Property Office (KIPO), and the United States Patent and Trademark Office (USPTO) (hereinafter referred to as the “Partners”) met in Brussels for the 2022 ID5 Annual Meeting, with some of the Partners joining the discussions online.

The World Intellectual Property Organisation (WIPO) was present at the meeting as an observer.

During the Annual Meeting on 27 October the Partners welcomed the publication of the “ID5 2022 Booklet”. The Partners also adopted a joint statement that focused on adaptable and interoperable industrial design systems concentrating on emerging technologies, and broader cooperation with a wide group of users. 12 ongoing projects were discussed, of which 4 were concluded, notably:

• Study on the Admissibility of Internet Information as Legitimate Disclosure for Novelty Examinations

• Deferment of Publication

• A Study of Term of Protection (with summary chart)

• Remedies and Relief for Industrial Design Infringement (with summary chart)

At the same time, four new projects were adopted:

• E-Learning Platform for SMEs

• Assessment of Design

• Indication for Registered Designs

• Protection of Digital Design in Metaverse

On 28 October the ID5 offices welcomed in person representatives of some EU user associations (AIM, ANIPA, BMM, BusinessEurope, ECTA, FICPI, GRUR and MARQUES), as well as users from INTA and the Japan Intellectual Property Association. They also welcomed 56 Chinese, Korean and US users online thanks to the hybrid format of the event. The users were informed of the recent developments in the ID5 offices and the highlights of the Annual Meeting. The session also provided an opportunity to discuss the challenges of new technologies, hybrid work, recommended design practices, electronic exchange of priority documents, and communication. The KIPO has been serving as Secretariat for the group as of the conclusion of the Annual meeting, and will remain in this role until the end of the 2023 Annual Meeting.

The Catalogue of Industrial Design Rights Remedies in ID5 Jurisdictions is a reference for users. It gives an overview of the available remedies and relief for industrial design infringement for each of the Partners, how this remedy/relief is determined and lists the damages available under the different jurisdictions.

The Catalogue on the Term of Protection for Industrial Designs compares the existing scope of legal frameworks and office practices related to the various terms of protection for industrial designs, including an overview of the fees for receiving a term of protection.

Virtual Meeting November 1-2, 2021

The China National Intellectual Property Administration (CNIPA), the European Union Intellectual Property Office (EUIPO), the Japan Patent Office (JPO), the Korean Intellectual Property Office (KIPO), and the United States Patent and Trademark Office (USPTO) (known as ‘’the Partners”) met virtually on 1-2 November 2021, for the ID5 Annual Meeting hosted by the CNIPA. The meeting was also attended by the World Intellectual Property Organization (WIPO) as an observer.

At the closed session on 1 November, the Partners discussed 13 ongoing projects and 1 new project proposed jointly by the CNIPA and the EUIPO. With their goals achieved, 3 projects on priority document exchanges, quality management and non-patent literature data resources were successfully concluded.

The outcomes of these three projects were published on the ID5 website:

The Partners agreed to proceed with the new project concerning an informational user guide on view and drawing requirements. The Partners also agreed to update the ID5 Operational Guidelines with further guidance on the procedures for updating the published work products, enhanced utilisation of the ID5 website, and meeting arrangements under emergency situations. The Partners concluded the closed session with a discussion on the ”2021 Joint Statement of the ID5 Partners” and reached a consensus on the text. The document is set to be published on the ID5 website after each Partners’ clearance process is completed.

At the user session on 2 November, user representatives from the jurisdictions of the Partners were provided an office update by each of the Partners as well as a progress update on the ID5 cooperative projects. The users participated by sharing their views with the Partners on the challenges presented by the pandemic and their expectations. The Partners also elaborated on their respective measures they had taken to minimise the effects of the pandemic as well as other initiatives to better meet user needs.

The EUIPO will act as Secretariat for the group upon conclusion of the 2021 Annual Meeting until the end of the 2022 Annual Meeting.

WIPO DAS is an electronic system allowing priority documents and similar documents to be securely exchanged between participating IP offices, helping applicants electronically meet the Paris Convention’s requirements for providing priority and similar documents to participating offices.

CNIPA commenced operation as both a depositing Office and an accessing Office to WIPO DAS for industrial designs on 15 April 2013. The ID5 project led by CNIPA and USPTO was adopted at the 2016 Annual meeting with the aim to determine the feasibility and implementation timelines for ID5 Partners joining WIPO DAS. Subsequently CNIPA was followed by KIPO (20 July 2018), USPTO (1 October 2018), JPO (1 January 2020) and EUIPO (11 July and 12 September 2020).

Thereby the Partners achieved the project objective to provide more choices and better services to users in conformity with the aims of ID5, including improving the user-friendliness of industrial design systems. At the 2021 Midterm meeting ID5 Partners agreed to close the project in the 2021 Annual Meeting, and present the summary during the User Session of this year.

The ID5 discussions focused on continuous and current projects, including those on non-patent literature data resources, priority document exchanges, recommended design practices, terms of protection, remedies for design infringement, admissibility of Internet information, quality management, communication and new technologies, etc. ID5 Partner offices also reviewed a new CNIPA-EUIPO project proposal for a User Manual on view and drawing requirements. The Operational Guidelines for ID5 have been revised to take into account the possibility of organising virtual meetings, following updates of the existing work products and the better utilization of the ID5 website.

The Partner Offices also discussed preparations for the 2021 ID5 Annual Meeting, which may take place virtually or in person depending on the global health situation.
